WE DO NOT WARRANT THAT:

• THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
• DEFECTS WILL BE CORRECTED
• THE SERVICES OR SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• THE VERIFICATION RESULTS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS OR PERSONAL INFORMATION STORED THEREIN
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES
• ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE THAT MAY BE TRANSMITTED THROUGH THE SERVICES

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST SIX MONTHS.

12. Indemnification

You agree to defend, indemnify, and hold harmless Onboard.me, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your User Data or Content
• Your use of the Services
• Your violation of any third-party rights

13. Term and Termination

13.1 Term

These Terms shall remain in full force and effect while you use the Services or maintain an Account with us.

13.2 Termination by You

You may terminate these Terms by:

• Closing your Account
• Discontinuing use of the Services

13.3 Termination by Us

We may terminate or suspend your Account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Suspected fraudulent, abusive, or illegal activity
• Non-payment of fees
• Extended periods of inactivity

13.4 Effect of Termination

Upon termination:

• Your right to access and use the Services will immediately cease
• We may delete or retain your User Data as outlined in our Privacy Policy
• Provisions of these Terms that by their nature should survive termination shall remain in effect

• If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in Bangkok, Thailand
• The arbitration shall be conducted in accordance with the rules of the Thai Arbitration Institute
• The language of arbitration shall be English

Nothing in these Terms will prevent either party from seeking injunctive relief in a court of competent jurisdiction.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services and supersede all prior agreements and understandings.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
